A. When to use

Follow these procedures when a representative payee for an SVB-entitled individual requests voluntary termination of SVB and the representative payee is not the individual's legal guardian. (Follow VB 01505.011 when a voluntary termination is made by the SVB beneficiary or his or her legal guardian.)

B. Procedure

Follow these steps:

Would termination clearly advantage the beneficiary?

IF YES, follow instructions in VB 01505.011. Obtain a written request (VB 01505.011B) from the payee, not the beneficiary.

IF NO, go to Step 2.

Does the payee actually want to discontinue serving as payee rather than terminate SVB?

IF YES, develop for a new payee (see GN 00504.100 and VB 00501.001).

IF NO, go to Step 3.

Would termination clearly disadvantage the beneficiary? Determine this by contacting the beneficiary (only if legally competent) and any individuals who may have responsibility for the beneficiary's care and/or act for the beneficiary such as a legal guardian or relative.

IF YES, develop for a new payee (see GN 00504.100 and VB 00501.001). Fax the voluntary termination request and any materials pertaining to the request to (410) 966-7025. Include the SVB individual's SSN and annotate “Attention: SVB Voluntary Termination.”

IF NO , go to Step 5.

Does the legally competent beneficiary want SVB entitlement to continue or is he or she unsure?

IF YES, develop for a new payee (see GN 00504.100 and VB 00501.001). Fax the voluntary termination request and any materials pertaining to the request to (410) 966-7025. Include the SVB individual's SSN and annotate “Attention: SVB Voluntary Termination.”

IF NO , follow instructions in VB 01505.011. Obtain a written request from the payee and the beneficiary.

NOTE: When developing the need for a new payee, reevaluate the beneficiary's capability if there is an allegation or indication that the beneficiary may be capable (GN 00502.055).
