RS 00605: Initial Computation of the PIA - Recomputations and Recalculations

A. Policy
1. Eligibility Requirements
RIB or survivor computation
NH attains age 62 1/79 - 12/83 and, for survivor claim, dies in or after age 62 attainment month; and
NH has earnings before 1979.
2. Exception
Nh must not have period of disability that began before 1979 unless:
there is a period at least 12 months prior to month of attainment of 62 or death when NH is not entitled to DIB; or
the period of disability is disregarded.
B. Procedure
1. Determining the Transitional PIA
Determine elapsed years, computation years, and divisor months. see RS 00605.016 ff.
Determine base years. (Years after 1950 and up to, but not including, the year of eligibility.) see RS 00605.017.
Compute the dividend using actual earnings.
Determine a PIA using the 6/78 PIA tables in RS 00605.950.
Years wholly within a period of disability are excluded when an exclusion computation is advantageous.
Add COLAs for ELY and later.
2. Recomputation
The law prohibits the recomputation of the 78 NS Transitional Guarantee PIA to include earnings in or after the year of eligibility. Additional earnings may be used to increase the PIA under the 78 NS AIME PIA or the special minimum only. Add cost-of-living increases beginning with the eligibility year.
