B. Process - Fowlkes AR Relief Case Resumption Processing

1. Use of the Fugitive Felon Processing Exclusion Fax form for Fowlkes AR Relief Case Resumption Processing

See GN 02613.840C.1.c. for information on when the Fugitive Felon Fax form is necessary for Fowlkes AR relief case processing when the POS/FFEL screen does not work correctly.

2. Completion of the Fugitive Felon Processing Exclusion Fax Request for Fowlkes AR Relief Cases

Send the FAX form to the appropriate PC as indicated on the FAX form. In addition, annotate the subsequent blocks on the form with the appropriate case information as instructed below:

• BOAN

• NAME

• BIC

Check the OTHER block on the EXCLUSION CATEGORY.

Add the following in the REMARKS section of the FAX form:

• For Fully Favorable Relief Cases annotate in REMARKS: “PRIORITY – FOWLKES COURT CASE – RESUME BENEFITS EFF MM/YYY and Continuing—FULLY FAVORABLE RELIEF GRANTED.”

• For Partially favorable relief granted annotate in REMAKRS:

  “PRIORITY – FOWLKES COURT CASE – REINSTATE/SUSPEND BENEFITS EFF MM/YYYY Through MM/YYYY—PARTIALLY FAVORABLE RELIEF GRANTED.”

3. Completion of the Fugitive Felon Processing Exclusion Fax Request for Re-Suspension of Title II Benefits When the Beneficiary Moves Out of the Second Circuit

Send the FAX form to the appropriate PC as indicated on the FAX form. In addition, annotate the subsequent blocks on the form with the appropriate case information as instructed below:

• CAN

• BOAN

• NAME

• BIC

Check the OTHER block on the EXCLUSION CATEGORY.

Add the following in the REMARKS section of the FAX form:

• For Re-Suspension of Title II Benefits When the Beneficiary Moves Out of the Second Circuit After Receiving Fowlkes AR Relief annotate in REMARKS:

“PRIORITY – FOWLKES COURT CASE – SUSPEND BENEFITS EFF MM/YYYY –BENE MOVED OUT OF SECOND CIRCUIT.”
