GN 02613: Title II/Title XVI Fugitive Felons and Parole and Probation Violators

NOTE: On April 1, 2009, SSA changed its policy of not paying fleeing felons. Follow the instructions below only for felony warrants with offense codes 4901, 4902, or 4999. Follow the Martinez settlement instructions in GN 02613.860 – GN 02613.885 for all other felony warrant codes.
On May 9, 2011, SSA changed its policy and no longer suspends or denies benefits or payments based solely on a probation or parole violation warrant (i.e., warrants with offense codes 5011, 5012, 8101, 8102, or 9999 or “Blank” and an offense charge symbol of “probation or parole violation”). Follow the Clark Court Order instructions in GN 02615.100 – GN 02615.190 for all probation or parole violation warrants.
We will make additional changes to this section, as necessary, in the future.
A. Procedure — fugitive felon processing FAX instructions
Complete FAX requests for fugitive felon suspension cases as outlined in the following instructions.. Appropriate PSC FAX numbers appear on the form. Make sure that all entries are legible.
1. Explanation of entries
CAN: Show the wage earner's SSN.
BIC: Provide the beneficiary identification code for the individual subject to suspension.
BOAN: This is the beneficiary's own social security number.
NAME: Show the first name, middle initial, and last name of the individual subject to suspension.
DATE OF SUSPENSE: Show the first month for which suspension is appropriate in MM/YY format.
SUSPENSE TYPE: Suspension code “S9” with an RFST of “FUGFEL.”
NOTICE: the FO should send advance notification whenever required; i.e., all suspensions EXCEPT: first-party reports, beneficiary in non-pay status and closed period of suspension, require advance notification. Enter the date you sent the due process notice, and check the due process period or check that no due process notice is required as appropriate.
EXCLUSION CATEGORY: Check the appropriate exclusion category. Use the OTHER category only when directed in the "EXCEPTION" below or after consultation with your RFFC (RFFC) or Regional Systems Staff. If OTHER is checked, explain the reason in the REMARKS section of the form.
2. Regional fugitive felon coordinator (RFFC) and payment service center (PSC) contact information

B. Procedure — FO follow-ups on suspensions or reinstatements or resumptions
Tickle the MDW for 7 days to give time for the suspension action to show on the MBR for T2 exception cases. Call the PSC using the PSC contact information in GN 02613.995 when the diary matures and there is no suspension.
C. Procedure — FO forwarding documentation material to the PSC
Once a suspension action is on the MBR, forward copies of the advance notification letter (if sent) and any other documentation to the jurisdictional PSC. Do not fax this material. Annotate the material "Fugitive Felon (Suspension/Reinstatement/Resumption) Processed — Drop-file Material." Mail the documentation to the jurisdictional PSC address shown below.
