GN 02604: Penalties
TN 23 (01-17)
A. Title II resumption of benefits
Sixty days prior to the month benefits are to resume, contact the beneficiary to verify that the address, bank information, and other entitlement information is still current. Use the ASAN screen to input the sanction ending date following instructions in MS COMMON 005.005.
B. Title XVI resumption of benefits
1. Resuming Title XVI benefits after a six-month suspension
Sixty days prior to the month we resume benefits, contact the recipient to schedule a redetermination (RZ). FO technicians must set a tickle reminder for the RZ by using the DW01, RPOC or MDW.
We do not select RZs for N24 cases.
For instructions on completing an RZ review, see SI 02305.000.
NOTE: A 6-month sanction might occur at the end of another period of suspension, resulting in a total of 12 or more months of ineligibility. In that case, we will require a new application, as explained in GN 02604.445B.2.
2. Resuming Title XVI benefits after a 12- or 24-month sanction
When we suspend Title XVI benefits for 12 months or more, we terminate the record and the recipient must file a new application (see SI 02301.205). Sixty days prior to the end of the 12- or 24-month sanction period, contact the recipient to schedule an appointment to take a new application. Follow existing procedure in processing the new claim. In cases where we require a new application and a new period of eligibility starts, enter a Remark on the SSID to show the information about the prior sanction period.
C. Failure to cooperate
1. Failure to cooperate – Title XVI cases
If the person fails to contact the FO for a redetermination of Title XVI eligibility at the end of the 6-month sanction period, change the suspension to N20, beginning with the month after the sanction period ends (see SI 02301.235). When the person contacts the FO, follow normal rules for determining eligibility for months after the sanction period.
2. Failure to cooperate – Title II cases
If the person fails to provide necessary information prior to resumption of benefits at the end of the sanction period, change the suspension code beginning with the month after the sanction period ends. Leave in S9 but change the RFST to MISCEL and remove the WIC code beginning with the first month after the sanction period. When the person provides the information, pay benefits only for months after the sanction period.
