This case now involves accrued benefits of over $2,000. Therefore, it is necessary that a recommendation be made as to whether the accrued benefits should be paid in a single payment or installments.
3001.B ANTICIPATED ACCRUED BENEFITS OVER $2,000
Since we anticipate that this claim may involve accrued benefits of over $2,000, it is necessary that a recommendation be made as to whether the accrued benefits should be paid in a single payment or installments.
3001.C RECOMMENDATION FOR INSTALLMENT PAYMENTS
Your recommendation should be based upon a review with (a) name of proposed payee of his plans for using the accrual and any other pertinent information of which you are aware. Such review should be directed not only to finding out whether or not the accrued benefits will be utilized for the “use and benefit” of the beneficiary, but should lead to a judgment as to the payee's ability to administer the accrual. If you recommend installment payments, it will also be necessary to recommend the amount of each installment in even multiples of $100.
NOTE: The period of installment payments cannot exceed 18 months. Benefits are applied for the beneficiary's “use and benefit” when they are disbursed for his current support and maintenance, when they are accumulated for specific and foreseeable purposes of advantage to the beneficiary, and when they are properly conserved and invested, having regard to his individual requirements and particular circumstances.
