SI 00501: Eligibility Under the Supplemental Security Income (SSI) Provisions

Use the information in this section when you need to make a Permanent Residence Under Color of Law (PRUCOL) determination under the 1996 immigration reform Supplemental Security Income (SSI) eligibility rules. See information on “SSI eligibility for nonqualified aliens who were receiving SSI on 8/22/96 - 1998 “Grandfathering” legislation SI 00502.153.

A. Policy on PRUCOL

An alien who has entered the U.S. and continuously resided here before January 1, 1972 meets (PRUCOL), unless there is evidence DHS lawfully admitted the individual as a nonimmigrant. See information on when an alien is lawfully admitted but not for permanent residence in GN 00303.450.

B. Development and documentation for continuous residence

1. Alien in U.S. Before January 1, 1972

Use any of the following evidence:

  • School records, marriage license, voter registration card, insurance application, military service records, driver's license, medical records, etc.; or

  • Statements (obtain statements on an SSA-795, Statement of Claimant or Other Person) of two persons with a knowledge of the facts attesting that the individual was present in the U.S. before January 1, 1972, and the basis of their knowledge; or

  • SSA records, including the individual's social security number (SSN). (See the table in SI 00501.425B.4. (in this section) for highest group numbers in each SSN area issued prior to January 1, 1972. If the individual's SSN group appears in the table, assume presence in the U.S. prior to January 1, 1972; you do not need any further evidence. To determine if a recipient's SSN appears in the table, find the group number opposite the individual's SSN area number in the table in SI 00501.425B.4. If the group number in the individual's SSN is from the group in the table, or from a previously issued group (we issued the sequence group numbers as shown in SI 00501.425B.5. (in this section), we issued the SSN prior to January 1, 1972. For example, by January 1, 1972 we issued in area 237, odd-numbered groups 01-09 and even-numbered groups 10-98 and 02. Between January 1, 1972 and June 25, 2011, we issued even-numbered groups 04-08 and odd-numbered groups 11-45).

2. Continuous U.S. residence

Secure a signed SSA-795,( Statement of Claimant or Other Person) from the individual indicating the beginning and ending dates of all periods of residence in the U.S. The statement does not have to include the complete street address. The town or State is sufficient.

A statement showing no absence of longer than 6 months is sufficient to determine continuous residence in the U.S. since before January 1, 1972.

If you cannot find continuous residence since before January 1, 1972, determine if the individual met another category of PRUCOL before denying the claim.

3. AR field coding

If the individual meets the continuous residence criteria, code the citizenship/alien status (AR) field P. For details on alien or citizenship status, see SM 01005.630.

5. Order of issue of SSN group numbers January 1, 1972 through June 24, 2011

We issue SSN's in the following order:

  • Odd numbered groups 01 through 09

  • Even numbered groups 10 through 98

  • Even numbered groups 02 through 08

  • Odd numbered groups 11 through 4

On June 25, 2011, we began randomization of the SSN. Due to this change, you cannot use SSNs issued after June 24, 2011 to establish continuous residence.
