SI 00501: Eligibility Under the Supplemental Security Income (SSI) Provisions

A. Introduction
An individual must meet certain requirements with respect to United States residency and citizenship or alien status to be eligible.
B. Policy principles
1. Residency
An eligible individual must be a resident of the United States (see GN 00303.700), and
2. Citizenship/Alien Status
An eligible individual must be:
a citizen or national of the United States (see GN 00303.100), or
an alien lawfully admitted for permanent residence (LAPR) in the United States (see GN 00303.420), or
-
an alien permanently residing in the United States under one of the qualified alien categories found in SI 00502.100, or
an alien who meets the definition of a resident of the U.S. under color of law (PRUCOL) prior to August 22, 1996 and who was considered to have been receiving SSI benefits on August 22, 1996 as stated in SI 00502.150B.1, or
an alien who is lawfully present in the United States pursuant to Section 203(a)(7) (Refugees- conditional entry) if admitted prior to April 1, 1980, or
an alien who is paroled under Section 212(d)(5) of the Immigration and Nationality Act and the parole status is issued for a minimum of one year (see SI 00501.450), or
an Iraqi or Afghan Special Immigrant admitted to the U.S. pursuant to Section 101(a)(27) of the INA, or
an alien who is deemed to be a Victim of Severe Forms of Human Trafficking who was admitted to the U.S. pursuant to Section 101 (a)(15)(T) of the INA.
