DI 425: Court Cases

A. Policy

Individuals (“walk-ins”) may inquire about class membership or request review by contacting SSA in person, in writing or by telephone.

B. Process

Walk-in inquiries are forwarded to:

  • SSA, ODIO

    Class Action Section (CAS)

    Attention: Dixon Coordinator

ODIO enters the data from the requests for review into the CATS system. ODIO associates the CATS alert/query package with the located Dixon claim(s) and screens for class membership per DI 42521.020.

If an individual contacts the PSC or ODIO instead of the FO about being a potential Dixon class member, the PSC or ODIO follows DI 42521.010C.

C. Procedure

1. PSC receives inquiry

Because the PSC cannot query CATS directly, take the following actions when inquiries are received:

a. Written inquiries

Send written inquiries to ODIO at the address shown in DI 42521.010B., under cover of a transmittal annotated “Process inquiry as Dixon response if claimant not on CATS.”

b. Telephone inquiries

If an individual calls the PSC:

  • Complete a “Request for Court Case Review/Change of Address Worksheet” (See DI 42521.095, Exhibit 10).

    Complete all of the claim number information only if claimant/payee/representative is requesting court case review. Do not complete the claims information when only reporting a change of address.

    NOTE: This information is required to establish a “walk-in” record on CATS.

  • Forward all worksheets to ODIO at the address shown in DI 42521.010B.

2. ODIO action on receipt of inquiry

  1. Query CATS. If the CATS query shows no record on the system, treat as a "walk-in" under Dixon and follow c. below.

  2. If the individual has been identified and a review notice has been mailed, but no response has been recorded on CATS, treat as a Dixon response and request for review.

  3. If the individual has not been identified as a potential Dixon class member, consider the inquiry as a request for review under Dixon .

  4. If an individual calls ODIO, complete the “Request for Court Case Review/Change of Address Worksheet” and forward the worksheet to CAS for entry into CATS.

  5. If a written inquiry is received in ODIO, verify the social security number (SSN) and enter into CATS.

  6. Send a status letter (see DI 42521.095, Exhibit 12) in response to all inquiries.

3. Completed folders

Please do not forward completed folders to The Class Action Section (CAS) located in Baltimore, Maryland. Upon completion of a case, the folder should be forwarded to the appropriate storage facility (PSC, WBDOC, ODO). CAS does not house completed folders.
