RS 02201: Statute of Limitations - Procedures

A. POLICY PRINCIPLE

1. General

An E/R may be revised at any time before the end of the time limitation.

2. SSA Initiates

SSA may revise the E/R if SSA initiates an investigation before the time limitation expires but the determination to revise the E/R is not made until after the time limitation expires.

B. OPERATING POLICY

1. Prompt Investigation

  1. The E/R will be revised under RS 02201.002A.2. only if the investigation was carried out as promptly as circumstances permitted, and

  2. There are no doubts that the E/R should be corrected. If there are any doubts, do not revise the record.

2. When Investigation Is Initiated

SSA on its own initiative takes action to resolve a question about the E/R. For example one SSA component requests another component to obtain additional information or evidence.

NOTE: The preceding rules do not apply if a written request for revision of the E/R is made or a claim for benefits is filed before the expiration of the time limitation. See RS 02201.010.
