RS 00301: Retirement, Survivors and Disability Requirements
TN 18 (08-04)
Policy
1. Individual currently insured
An individual is currently insured if he/she has at least six QC's during any one of the following periods:
The 13-quarter period ending with the quarter of death;
The 13-quarter period ending with the quarter in which he/she became entitled to a RIB; or
The 13-quarter period ending with the quarter in which he/she most recently became entitled to a DIB (e.g., disability onset date).
IMPORTANT: If the worker is an alien whose SSN was first assigned on or after January 1, 2004, then he/she must meet additional requirements of Section 211 of the Social Security Protection Act of 2004 (Public Law 108-203) to be currently insured and to establish entitlement based on his/her earnings. See RS 00301.102 for a full discussion of these requirements.
2. Determining the 13 quarter period
In determining the 13-quarter period:
Do not count as part of such 13-quarter period any quarter any part of which was included in a period of disability except for the first and last quarters of the period of disability if they are QCs.
An intervening period of disability may extend the 13-quarter period during which the six QC's necessary for a currently insured status must be acquired.
