GN 02610: Title II/Title XVI (Windfall) Offset

A. PROCEDURE — FO TITLE XVI OFFSET

  • Count the retroactive title II benefit as though paid when due.

    NOTE: Prior to 9/08/95 the MBR/SSR interface automatically posts the title II benefits as type G income if no SSI was paid. Beginning 09/08/95 the system will not post type G income when the title II CMA is paid unless the Title XVI CR inputs a win code of D when there is no SSI eligibility that can be established. See REMINDER.

  • See SM 01320.040 when the interface did not post income.

  • Apply title XVI offset before determining any reimbursement due the State under IAR.

    REMINDER: Title II offset will apply to claims processed 9/08 /95 or later. For information about recomputation of windfall offset in situations with or without installment payments, see GN 02610.050C.2.

B. PROCEDURE — PC TITLE II OFFSET

1. Non-couples Cases

  1. Subtract the title II offset amount first from the retroactive benefits due in the offset period.

  2. If any offset remains, subtract it from the retroactive title II due for months outside the offset period.

  3. Subtract any collectible SSI Overpayment, SI 02220.021

2. Couples Cases

  1. Offset previously computed for one member

    Subtract the additional offset amount from the retroactive title II benefits due the newly eligible member (GN 02610.037).

  2. Offset computed for both members of a couple simultaneously

    • Follow GN 02610.040 to compute offset amount and determine each member's prorated share.

    • Subtract this from the retroactive title II benefits due each member.

    • If the offset for member A exceeds the total retroactive title II benefits due him/her, subtract the remaining offset from the retroactive title II benefits due member B after member B's offset has been subtracted.

    • Subtract any collectible SSI Overpayment, SI 02220.021

C. EXAMPLE — COUPLES CASE

Joe and Sue Smith are entitled to title II and title XVI benefits. Joe's offset amount is $1250.00. Sue's offset amount is $400.00. Joe's retroactive title II benefits in the offset period are $1000.00. Total retroactive title II benefits due Joe are $1100.00. The $1250.00 in offset is first subtracted from the title II due in the offset period, reducing it to zero. He has no NCI. The remaining $250.00 reduces the retroactive title II due outside the offset period to zero leaving a balance of $150.00 offset to be collected.

Sue is due $500.00 total retroactive benefits, $200.00 in the offset period and $300.00 outside the offset period. Her offset amount is $400.00. The $400.00 reduces the title II due in the offset period to 0, and the title II due outside the offset period to $100.00. This $100.00 is then reduced by the $150.00 remaining offset from Joe, reducing Sue's NC1 to 0. The $50.00 remaining offset is excess offset and is not collected as an overpayment.
