GN 02409: Waiver and Voluntary Suspension of Benefits

A. When a beneficiary asks to waive payment
A beneficiary may ask to waive payment in order to receive or have increased benefits from another Federal or State agency. Do not approve a waiver, unless the other agency recognizes the validity of the waiver, and provides the expected benefit for the period of waiver. If there will be no benefit from the other agency, but the beneficiary insists on waiving the payment, document that this is an informed decision and accept the waiver request.
B. Verification of contact with another agency
Unless the beneficiary requires SSA assistance, ask the beneficiary to verify that the agency administering the other benefit recognizes the validity of the waiver. Obtain a signed statement that the contacted agency understands the effects of this action over the beneficiary’s signature.
If the beneficiary insists on waiving the payment, and this appears to be disadvantageous, refer the signed request to the ARC, MOS, for review.
