GN 02215: Methods of Recovery for Title II, Title XVI, and Title XVIII Overpayments - Part II

A. Operating Policy

Unlike waiver of recovery which precludes further recovery efforts, an overpayment for which collection efforts are discontinued remains subject to recovery (e.g., from future benefits payable to the debtor or to any other person on the same earnings record). If benefits are subsequently payable to the debtor on that record, the system will automatically initiate adjustment to recover the overpayment.

B. Operating Procedure

Where collection efforts were previously discontinued (TC 71 or TC 73) and the PC is on notice of a substantial change in the debtor's financial circumstances, or a TC 73 diary matures, the PC will update ROAR (TC 77) and resume refund efforts.
