A. Introduction

The rules governing retroactivity of foreign applications are established by the foreign countries and may vary from country to country. Further information concerning the retroactive life of foreign applications, where available, is contained in the subchapters covering the specific agreements.

B. Procedure

When foreign benefits are claimed, include in the claims file any evidence that might be used by the foreign country to establish an earlier filing date (e.g., a protective writing).
