A. Spouse

When the NH is insured only because of the transitional insured status provision, the claimant must have attained age 72 before 1969 to be entitled. The husband of an NH who was only transitionally insured can be entitled under this provision no earlier than May 1983.

B. Divorced spouse

A divorced spouse cannot be entitled on the E/R of an NH who is only transitionally insured. However, divorce does not terminate entitlement of the spouse of a transitionally insured NH if she or he had been married to the NH for at least 10 years (20 years for months prior to 1/79).
