DI 30005: Adjudicating Component Actions on Deficient Cases

A. Policy - corrective action

1. Onset date and ending date decisional deficiencies

If the case has another deficiency which requires corrective action by the adjudicating component or the claimant is already receiving a non-disability Title II benefit, the case will be returned to the adjudicating component for correction. Otherwise, the review component will correct these deficiencies and will advise the adjudicating component of the deficiency without sending the folder. The notification of the deficiency will include copies of the amended SSA-831-C3/U3 and SSA-4268-U4 rationale.

2. Cessation date decisional deficiencies

The review component will send these deficiencies to the adjudicating component for correction by SSA-1774-U5.

B. Procedure - DDS

Upon receipt of the SSA-1774-U5 deficiency transmittal and folder:

  • Take the action requested in the SSA-1774-U5.

  • Return the corrected case to the review component.

EXCEPTION: For cessation date decisional deficiencies in failure to cooperate cases, fax the SSA-832/833-C3/U3 to the review component for inputting of the review results and send the folder to the FO for effectuation of the cessation. If preferred, notify the review component by phone or email when the determination is prepared rather than faxing or sending a copy of the SSA-831-C3/U3.
