DI 28095: CDR Notice Instructions
TN 1 (10-15)
A. Title II CDR notice
The disability determination service (DDS) is responsible for preparing the Title II continuance notices in a determination of continuance based solely on medical reasons. The DDS will prepare and (if not subject to a Quality Assurance (QA) review) release the preprinted form SSA-L1013 (Social Security Notice of Continued Disability), see DI 13095.155. The examiner will specify in Item 29 of the form SSA-833 (Cessation or Continuance of Disability or Blindness Determination and Transmittal – Title II) that:
The office is to prepare the notice and “L1013” followed by the block number or numbers to be checked followed by the appropriate fill-in for the block in parentheses (for example, L1013-1 (4/86), 2(6)).

The block or blocks, that you should check for each specific case is shown in the chart in DI 28095.100 Stock Letters for Title II Only, Title XVI Only and Concurrent Title II and Title XVI Claims Continuances. Check Block 6 in most situations.
NOTE: If there is an investigation to determine continuing entitlement to benefits under the extended period of eligibility provisions, for notice instructions see DI 28055.035 through DI 28055.060.
1. Benefits suspended because of a felony conviction
If the benefits are currently in suspense because of a felony conviction, add the following paragraph to the bottom of the form SSA-L1013 (Social Security Notice of Continued Disability):
“Your benefits must remain in suspense since our records show that you are confined because of an offense that constitutes a felony”.
2. The case is subject to a QA review
If the case is subject to a QA review:
Do not date the notice,
Fold it under the flap of the mailing envelope, and
Place it in the file for release by the Office of Quality Review (OQR).

B. Title XVI CDR notice
For Title XVI only continuance determination, the DDS is responsible for notifying the recipient of the determination made in his or her case when a determination is a continuance.
The DDS will prepare and (if not subject to QA review) release a Title XVI continuation notice on the form SSA-L1014 (Supplemental Security Income Disability Information), see NL 00701.430. Check the block or blocks when applicable for each specific case situation shown in the chart in DI 28095.100 Stock Letters for Title II, Title XVI and Concurrent Title II and Title XVI Claims Continuances. Check Block 6 in most situations.
The paper case is subject to a QA review
If the paper case is subject to a QA review:
Do not date the notice,
Fold it under the flap of the mailing envelope, and
Place it in file for release by OQR.

C. Concurrent Title II and Title XVI CDR notice
1. Title XVI in current pay status
The DDS is responsible for notifying the recipient of the determinations made on both cases. In concurrent Title II and Title XVI continuing disability cases in which, Title XVI payments are in current pay status and there is a determination of continuance, complete Item 29 on the form SSA-832 (Cessation or Continuance of Disability or Blindness Determination and Transmittal – Title XVI). Complete Item 29 of the form SSA-833 (Cessation or Continuance of Disability or Blindness Determination and Transmittal –Title II). For the Title XVI portion of the case, follow the instructions in DI 28095.060B in this section. For the Title II portion of the case, follow the instruction in DI 28095.060A in this section.
2. Title XVI in non-pay status
Concurrent Title II and Title XVI cases in which the Title XVI case is in non-pay status, the Title II case requires a notice but not for the Title XVI case, see DI 28095.060A in this section . Enter “NLN” in Item 29 of Form SSA-832 (Cessation or Continuance of Disability or Blindness Determination and Transmittal-Title XVI).
NOTE: If a continuance implies a change from “blind” to “disabled”, see DI 28080.065.
