DI 28040: Medical Improvement Not Expected (MINE) or Medical Improvement Not Expected - Equivalent (MINE - Equivalent) Cases

Adjudicators will prepare a Cessation or Continuance of Disability or Blindness Determination and Transmittal (SSA-832 for Title XVI, SSA-833 for Title II) for all continuing disability review (CDR) determinations. For detailed instructions on completing these forms, see DI 28084.000.
If a continuance is indicated on a case where MINE or MINE-equivalent procedures are applicable, the adjudicator will annotate “MINE or MINE-equivalent CASE” in item 24 (Remarks) of the SSA-832 or SSA-833.
If the MINE or MINE-equivalent criteria no longer apply, the adjudicator will process the SSA-832 or SSA-833 as a “regular” CDR determination.
NOTE: Single decisionmaker (SDM) model protocol does not apply to CDRs. Therefore, the SSA-832 and SSA-833 must have a reviewing medical or psychological consultant (MC/PC) signature or an approved electronic signature.
