DI 13015: Special CDR Issues

A. Policy
The DDS or PC may request FO assistance in locating the individual, in obtaining the individual's cooperation, or in conducting the medical CDR interview.
B. Procedure
After completing development and documenting the file according to
DI 13015.005A. (FTC) and DI 13015.005B. (WU), proceed as follows:
1. PC Requests
If the beneficiary cooperates or is located, return the case to the PC; the PC completes the CDR as usual (See DI 13005.000).
If the beneficiary fails to cooperate, the PC forwards the folder to the FO. If the beneficiary fails to cooperate with the FO, the FO follows the FTC procedures in DI 13015.001. The CDR is not sent to the DDS for a medical determination per DI 13015.001C.
If the beneficiary's whereabouts are still unknown, the FO accepts jurisdiction and prepares the determination (See DI 13015.005B.).
2. DDS Requests
If the beneficiary cooperates or is located, return the case to the DDS; the DDS completes the CDR as usual (See DI 28000.000).

If the beneficiary fails to cooperate, return the case to the DDS; the DDS makes a determination based on the evidence in the record.
NOTE: These are cases where the beneficiary did cooperate with the FO, but then failed to cooperate with the DDS. Once the beneficiary has cooperated with the FO, the DDS must make a medical determination. However, if the beneficiary fails to cooperate with the FO, the CDR is not sent to the DDS for a medical determination.
If the beneficiary's whereabouts are still unknown and the file does not contain sufficient medical documentation for the DDS to prepare a determination, the FO accepts jurisdiction and prepares a determination per DI 13015.005B.2.
