DI 11055: Supplemental Security Income (SSI) Disability Cases

Sometimes a CDB or DWB beneficiary is terminated for a non-medical reasons (e.g., because of marriage), and later files for SSI. In this situation, obtain a Master Benefit Record (MBR) query.
It is not necessary to send the Title XVI claim to the Disability Determination Services (DDS) for a new disability determination if the individual meets the following conditions:
The CDB or DWB was terminated for non-medical reasons;
The Title XVI claim is filed within 12 months of the date of the CDB or DWB terminating event;
The claimant does not allege blindness;
The claimant does not allege medical improvement or work activity; and
A medical re-exam was not scheduled.
Adopt the prior Title II medical determination if the individual meets all of these conditions, taking the following actions:
Place the MBR query in the official folder;
Complete a Report of Contact (RC) citing this POMS section as authority for not requesting a disability determination; and
Process the Title XVI claim in the field office (FO) in accordance with current system input instructions.
Complete an SSA-831 Disability Determination and Transmittal. Refer to DI 11011.020.
